HMRC announce they have sought permission to appeal the Weald Leasing decision

HMRC have just announced in Revenue & Customs Brief 8/08 that they ‘have sought permission to appeal to the Court of Appeal against the decision of the High Court.

The High Court decided that the structure in the Weald Leasing case was not abusive. This was a blow for HMRC.

It will no doubt be some time before the case is heard before the Court of Appeal so any plans you had to use the decision in Weald Leasing should be put on hold.

I’ll bring further news on these issues as and when they are released.
